TERMS OF MEMBERSHIP at YourActionsPay.com


By creating an YourActionsPay Account, you are agreeing to the following Terms of Membership. Violation of any of these Terms may lead to termination of your account and forfeiture of your earnings and referrals. If you do not agree with these Terms of Membership, please do not create an YourActionsPay Account.

YourActionsPay reserves the right to modify these Terms of Membership at any time without notice to Users.

I. MEMBERSHIP

1. Valid Information

Users must provide a valid E-Mail Address during registration in order to activate their YourActionsPay Account. In addition, any time users provide information to YourActionsPay, it must be accurate. This includes, but is not limited to, the registration process, user profile, and surveys.

2. Duplicate Accounts

Users may not create more than one Account with YourActionsPay. In addition, we do not allow:

(a) More than one Account in the same Household
(b) More than one Account with the same Mailing Address
(c) More than one Account using the same Computer
*NOTE* If (a), (b) or (c) is found to be TRUE, then all associated accounts will be removed from our database and not be paid - no matter how much the accounts have earned or in pending payout statuses.

3. Signup Bonus

To qualify for the Signup Bonus, users must:

(a) Be located in the U.S. and have a U.S. Mailing Address
(b) Check the minimum number of Co-Registration (often referred to as "Opt-In" and "Opt-Out") boxes required on the Signup Form (if applicable)
(c) Complete the user profile located in the Member's Section

4. Account Cancellation

Users may cancel their account any time by logging into the Member's Section and clicking the "Cancel Account" link. In addition, all Paid E-Mails sent to Users include a link to the cancellation page. If a User cancels their account, they will forfeit their earnings and referrals. In addition, any pending payments for that User are removed.


II. REFERRALS

1. Tracking

Users can use their Referral URL to refer other Users to YourActionsPay. Users can find their Referral URL in the Member's Section. Because YourActionsPay allows only one Account per Computer, our referral tracking software will not allow one User to refer another User if they are using the same Computer.

2. SPAM

Users may not SPAM in order to refer other Users to YourActionsPay. We cannot possibly list all acceptable and unacceptable methods of advertising. If a User has a specific question as to whether or not a particular advertising method is acceptable, they should contact us prior to engaging in that action.

(a) Users may not send Unsolicited E-Mail advertising YourActionsPay
(b) Users may send Solicited E-Mail to their subscribers advertising YourActionsPay. However, Users must adhere to all current legislation, including the CAN-SPAM Act of 2003. As part of the CAN-SPAM Act of 2003, Users must scrub their subscribers against our Suppression List and include a link for subscribers to add themselves to our Suppression List. For more information on our Suppression List, please contact us. YourActionsPay reserves the right to refuse distribution of our Suppression List for any reason.


3. Refer-a-Friend Service

Users may use our Refer-a-Friend Service to automatically send an E-Mail notification to their friends. However, if the User's Refer-a-Friend E-Mail results in a SPAM complaint, the User's Account may be terminated. Users should use the Refer-a-Friend Service to notify only their close personal friends.

4. False Advertising

Users may not make untrue or exaggerated statements when advertising YourActionsPay. For example, a User may not put on their Web Site: "Join YourActionsPay and get paid $1.00 for every E-Mail you read!" If the User provides information about YourActionsPay on their Web Site, they must ensure the information is updated and accurate.

5. Referral Bonuses

The Referral Bonus is credited to a User's account when the User they referred has requested and received their first check payment from YourActionsPay. Gold Membership and Banner Impressions payments do not count as a User's first payment.


III. INACTIVITY

1. Invalid E-Mail Address

If YourActionsPay receives a bounce-back error message when sending an E-Mail to a User, that User's Account will be deactivated. A bounce-back message may occur if the User has added YourActionsPay to their "Ignore List" or marked a message from YourActionsPay as SPAM. Users should add the address paidemail@YourActionsPay.com to their "Allow List" and/or Address Book.

2. Failure to Confirm Paid E-Mails

If a User fails to confirm 10 consecutive Paid E-Mails from YourActionsPay, their Account will be deactivated. YourActionsPay reserves the right to change this number at any time.

YourActionsPay sends a minimum of 3 Paid E-Mails per week to U.S. Users. It is the User's responsibility to ensure our Paid E-Mails reach their Inbox. If the User is not receiving our Paid E-Mails, they should add the address paidemail@YourActionsPay.com to their "Allow List" and/or Address Book. If that does not correct the problem, the User should contact their E-Mail provider or simply use a different E-Mail Address.

3. Reactivation

If a User's Account becomes inactive, they can reactivate it at any time by logging into the Member's Section. The User will then have the option to have a Confirmation E-Mail sent to them. When the User clicks the link provided in the Confirmation E-Mail, their Account will be reactivated.

4. Permanent Removal

If a User's Account remains inactive for a period of 3 months without being reactivated, their Account will be permanently removed and all earnings will be forfeited.

5. Payment Requests

Payment Requests are removed if a User's Account becomes inactive. The automated system that deactivates Users based on the above criteria runs immediately before payments are processed. Therefore, it is possible for a User's Account to be active right up until their payment is processed. YourActionsPay urges Users to ensure their Account remains active by confirming Paid E-Mails sent to them in order to avoid any delay in processing payments.


IV. CA$H OFFERS

1. Terms of Offers

YourActionsPay is not responsible for the Terms and Conditions of any of the Offers listed on our Web Site. Users should carefully read all of the Terms and Conditions of an Offer before completing it. YourActionsPay is not responsible for any billing or ensuing contracts between Users and Offer providers. YourActionsPay does not have contact information for Offer providers. Users should contact Offer providers directly for all questions relating to the Offer.

Some Offers provide rewards to Users in addition to the Cash reward offered by YourActionsPay, such as Gift Cards, Free Gas, Digital Cameras, and others. These rewards are provided by the Offer provider and not YourActionsPay. Often times, Users must meet requirements that are not necessary to receive the Cash reward from YourActionsPay in order to qualify for the additional rewards. Users should be sure to read all of the Terms of the Offer to determine what those requirements are. YourActionsPay is not responsible for these additional rewards.

YourActionsPay diligently investigates all Offers before they are listed on our Web Site. However, there are times when Offer providers change the Terms of an Offer without notifying us. Therefore, YourActionsPay makes no guarantees on the accuracy of the Offer descriptions listed on our Web Site. In addition, if an Offer provider changes the payout of an Offer, the User may receive a lower amount than what was indicated at the time they completed the Offer.

2. Offer Completion

Users may complete an Offer only if they have not completed the Offer in the past, either through YourActionsPay, any other Web Site, or with the Offer provider directly. Users will not be credited for completing an Offer if they have already completed the Offer in the past.

Users must complete the Offer by clicking on the Offer from our Web Site and completing all of the Offer requirements as given by the Offer provider. The User must not return to the Offer provider's Web Site at a later date or complete the Offer via telephone, as this interferes with our ability to track offer completion.

Users should ensure their Web Browser is set to allow all Cookies to ensure proper tracking occurs. In addition, Users should ensure they do not have anti-virus and/or anti-spyware software running that is set to override the Browser's Cookie settings.

3. Offer Crediting

Most Offers are credited to the User's YourActionsPay Account instantly after completion; however, some Offers can take up to 30 days to credit. The amount of time an Offer takes to credit is solely dependent on the Offer provider, and YourActionsPay is not responsible for this delay. Users should read and comply with all of the Offer requirements to ensure timely credit.

YourActionsPay does not guarantee a User will receive credit for completing an Offer. The Offer provider has the final say in whether or not a User receives credit. If YourActionsPay receives credit from the Offer provider, then we will issue credit to the User; however, if the Offer provider fails to issue credit to YourActionsPay, we cannot credit the User.

Users should save all Confirmation E-Mails received from Offer providers after completing an Offer. Often times those E-Mails can be used to manually credit the User's Account. However, presenting the confirmation email does not guarantee you will receive credit for completing an offer.

Many of the Offers listed on YourActionsPay include a free trial so that Users can evaluate the product or service without cost. Users should not complete the Offer unless they have a genuine interest in the product or service. Canceling a free trial immediately after joining may interfere with our tracking and may result in not being credited or having credit revoked. Morever, completing and subsequently canceling a large number of free trial Offers may be grounds for non-payment, in the sole discretion of YourActionsPay and the associated Offer providers.


V. PAYMENTS

1. Requesting Payment

Users can request payment by logging into the Member's Section and clicking the "Request Payment" link. A description of each payment request method will be displayed, and if the User's Account balance is large enough, a link to request that method of payment will also be displayed. Currently, the minimum amount required to request a Check payment is $30.00; however, this amount may change. Users may have only one pending payment request at a time.

2. Payment Schedule

Payments are processed on a Net-30 basis. That means payment requests are processed 30 days after the end of the month in which the payment was requested. For example, a payment request that takes place any time in October would be processed on December 1. After requesting payment, Users can view their scheduled payment processing date by logging into the Member's Section and clicking the "Payment History" link.

Payments are processed on the 1st of every month and generally mailed via USPS by the 5th, depending on the day of the week and how many payment requests there are for that month.

All payments are inspected immediately prior to processing. Payment requests belonging to Users who have become inactive (as described above) or who have duplicate accounts will not be processed and will be removed.

3. Fraud Prevention

YourActionsPay reserves the right to request further information from Users to ensure they have not fraudulently completed offers. This information may include, but is not limited to, a copy of the credit card statement that was used to complete the offers, in order to ensure a stolen credit card was not used.

YourActionsPay reserves the right to place any payment request on hold, for any reason, until the requested information has been provided by the User. Ample notice will be given to the User to provide this information. If the User does not provide this information before their payment is scheduled to be processed, their account will be suspended until they do so.
